Deontic Epistemic stit Logic Distinguishing Modes of 'Mens Rea'

چکیده

Most juridical systems contain the principle that an act is only unlawful if the agent conducting the act has a `guilty mind' (`mens rea'). Different law systems distinguish di erent modes of mens rea. For instance, American law distinguishes between `knowingly' performing a criminal act, `recklessness', `strict liability', etc. I will show we can formalize several of these categories. The formalism I use is a complete stit-logic featuring operators for stit-actions taking e ect in `next' states, S5-knowledge operators and SDL-type obligation operators. The di erent modes of `mens rea' correspond to the violation conditions of di erent types of obligation de nable in the logic.

Reasoning About Obligations in Obligationes: A Formal Approach

Despite the appearance of ‘obligation’ in their name, medieval obligational disputations between an Opponent and a Respondent seem to many to be unrelated to deontic logic. However, given that some of the example disputations found in medieval texts involve Respondent reasoning about his obligations within the context of the disputation, it is clear that some sort of deontic reasoning is involv...

How do pessimistic agents save miners? A STIT based approach

This paper develops a new STIT based deontic logic, pessimistic utilitarian deontic logic, capable of analyzing the miners puzzle. The key idea of the semantics of this logic is: one set of possible worlds is better than another set of possible worlds iff the worst world in the first set is better than the worst world in the second. This semantics gives an idea to write predictions in the miner...

Action Types in STIT Semantics

Stit semantics grows out of a modal tradition in the logic of action that concentrates on an operator representing the agency of an individual in seeing to it that some state of affairs holds, rather than on the actions the individual performs in doing so. The purpose of this paper is to enrich stit semantics, and especially epistemic stit semantics, by supplementing the overall framework with ...

Prescriptive and Descriptive Obligations in Dynamic Epistemic Deontic Logic

Normative sentences can be used to change or to describe the normative system, known as prescriptive and descriptive obligations respectively. In applications of deontic logic it is important to distinguish these two uses of normative sentences. In this paper we show how they can be distinguished and analysed in a dynamic epistemic deontic logic.
